Rosner Obtains Summary Judgment

Trial Attorney, Leonard A. Rosner, recently obtained summary judgment dismissing a lawsuit brought against G&I client, the City of Auburn.  The plaintiff in the case of McAvaney v. City of Auburn (Supreme Court, Cayuga County) was seriously inujured while riding her bicycle across an intersection.  She alleged that she was caused to fall when her bicycle struck an uneven sidewalk edge.  Rosner established that the City of Auburn was not legally responsible for the accident because it neither owned nor controlled the sidewalk.  "The judge's decision ends a three year old dispute for Auburn, which faced considerable exposure in light of the alleged injuries sustained in the accident," said Rosner.  "We regret the plaintiff's injuries, but Auburn was simply not at fault."
